Antitrust Implications of the NFLs 3-Year Eligibility Rule

Authors: Janice E. Rubin, American Law Division

Abstract: This memorandum concerns the rule promulgated by the National Football League (NFL) in 1990 pursuant to which an athlete is ineligible to enter the NFL Draft until he has been out of high school for at least three years since his class graduated. The memorandum first presents an overview of U.S. antitrust law and then presents a suggested alternative view for analyzing the eligibility rule under the labor law.
