Abstract: This report details the recent controversy over the Department of Labor advisory that suggested that employers would be responsible for the health and safety of their employees who work from home. It discusses the advisory, the Department's subsequent response, and addresses a number of legal issues raised regarding the authority of the Department of Labor to apply the provisions of the Occupational Safety and Health Act to teleworkers.
